Terms & Conditions
Circle of 6 is a social dining experience that brings together groups of six single adults for organised dining events at selected restaurants (Events). We manage all aspects of event coordination, including venue selection, attendee matching and booking arrangements. You register your interest through our online platform (Platform), and if selected, simply turn up and enjoy the evening.
These terms and conditions (Terms) are between you as an individual and us (ABN 18 438 374 55). These Terms apply from the time you create an account until it is closed or terminated and govern your use of our Events and Platform (together, the Services). You cannot use the Services unless you agree to these Terms.
Capitalised words have defined meanings, as set out at the end of these terms.
Membership
For anyone interested in registering to be a member, you must:
- Be at least 18 years old.
Not be in a committed romantic relationship.
Provide accurate, current and complete information when registering.
You may be required to verify your identity before being approved to book an event, including by uploading a driver’s licence or government-issued photo ID. We may decline membership where identity cannot be verified to our reasonable satisfaction, and any information provided for verification will be handled in accordance with our privacy policy.
Events
We list available events on the platform from time to time. You may register your interest in an event through the platform.
Registration of interest does not guarantee your selection for an event. We have absolute discretion in selecting attendees for each event.
Once selected, we will contact you with an invitation to confirm your attendance. Your place at the event is only secured upon payment of the booking fee. We will send you an email confirmation once your booking fee payment has been received and your place at the event is secured.
Prior to your event, we will send you a confirmation message including the first names of other confirmed attendees.
Following an event, we may contact you to ask whether you consent to sharing your contact details with another attendee who has expressed interest in connecting with you. We will only share your contact details with your express permission.
The booking fee is non-refundable unless we cancel the event.
The booking fee does not include the cost of any food, drinks or other expenses incurred at the restaurant.
Allergies, Dietary Requirements and Alcohol
It is your sole responsibility to notify the restaurant or venue directly of any dietary requirements, food allergies or intolerances prior to attending an event.
Alcohol may be available for purchase at events at your own cost, responsibility and risk, and we are not liable for any loss, injury or damage arising from its consumption.
Code of Conduct
By using the Services, you agree to:
Provide accurate and truthful information in your Account and keep it up-to-date;
Notify us immediately if your relationship status changes; and
Treat all other attendees, restaurant staff and our team with respect.
You must not:
Misrepresent your identity, age or relationship status;
Harass, bully, intimidate, defame or otherwise mistreat any person;
Use the Services for any commercial, fraudulent or unlawful purpose; and
Share another attendee’s personal information without their consent.
Personal Information
We collect, hold, disclose and use any personal information you provide to us in accordance with our privacy policy, available on the platform, and applicable privacy laws.
Intellectual Property and Data
We own all intellectual property rights in the services. This includes how the Services look and function, as well as our copyrighted works, trademarks, inventions, designs and other intellectual property. You agree not to copy or otherwise misuse our intellectual property without our written permission, and you must not alter or remove any confidentiality, copyright or other ownership notice placed on the Services.
We may use any feedback or suggestions that you give us in any manner which we see fit (for example, to develop new features), and no benefit will be owed to you as a result of any use by us of your feedback or suggestions.
You retain ownership of any data you input into the Services (Your Data). You grant us a limited licence to access, analyse, store, and otherwise use your data solely to supply and improve the services, diagnose problems, and perform analytics. You acknowledge that because of the nature of the internet, the processing and transmission of your data may occur over various networks.
The content on our platform is for general information purposes only; it may change without notice, and we do not warrant that it is accurate, complete or up-to-date, or that access will be uninterrupted or error-free.
This clause will survive the termination or expiry of these Terms.
Consumer Law Rights
In some jurisdictions, you may have guarantees, rights or other remedies provided by law (Consumer Law Rights), and these Terms do not restrict your Consumer Law Rights. We will only be bound by your consumer law rights and the express wording of these terms.
Subject to your consumer law rights, we do not provide a refund for a change of mind or change in circumstance.
If you accept these Terms in Australia, nothing in these Terms should be interpreted to exclude, restrict or modify the application of, or any rights or remedies you may have under, any part of the Australian Consumer Law (as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
This clause will survive the termination or expiry of these Terms.
Disclaimer
We do not guarantee any particular outcome from attendance at any event, including the formation of any personal or romantic connection. We are not a dating agency, matchmaking service or introduction agency. Any interactions between you and other attendees, whether during or following an event, are entirely at your own risk.
Liability
To the maximum extent permitted by law, we will not be liable for any liability arising from or in connection with:
- any act or omission of any restaurant or venue at which an Event is held;
- your failure to notify a restaurant or venue of your dietary requirements or allergies;
- the quality, safety or suitability of any food, drinks or services provided by a restaurant or venue;
- any cancellation, change or closure by a restaurant or venue;
- any interaction or conduct between attendees at an Event, whether during or following the Event;
- your computing environment; and
- any use of the Services by a person other than you.
- Our aggregate liability to you is limited to the booking fee paid by you for the relevant event. Neither party will be liable for any consequential loss.
This clause will survive the termination or expiry of these Terms.
Suspension and Termination
We may suspend or terminate your account immediately if we reasonably believe you have breached these terms, provided false or misleading information, do not meet the eligibility requirements or engaged in conduct harmful to other attendees or the integrity of the services. We will notify you of any suspension and, where possible, work with you to resolve the matter.
You may close your account at any time by notifying us through the platform or via our nominated email address.
Upon termination or closure of your account, you will lose access to the services, and any booking fees already paid are non-refundable.
This clause will survive the termination or expiry of these Terms.
General
Disputes: Neither we nor you may commence court proceedings relating to any dispute arising from, or in connection with, these Terms (Dispute) without first meeting a representative of the other party within 10 business days of notifying that other party of the dispute. If the parties cannot resolve the dispute at that meeting, either Party may refer the dispute to mediation administered by the Australian Disputes Centre.
Events Outside Our Control: We will not be liable for any delay or failure to perform our obligations (including the Services) if such delay or failure is caused or contributed to by an event or circumstance beyond our reasonable control.
Governing law: These Terms are governed by the laws of Queensland, and any matter relating to these Terms is to be determined exclusively by the courts in Queensland and any courts entitled to hear appeals from those courts.
Illegal Requests: We reserve the right to refuse any request for or in relation to the Services that we deem inappropriate, unethical, unreasonable, illegal or otherwise non-compliant with these Terms.
Variations: We may amend these Terms at any time by providing written notice to you. By clicking “I accept” or continuing to use the Services after receiving notice, or 30 days after notification (whichever is earlier), you agree to the amended Terms. If you do not agree to the amendment, you should cease using the services and close your account.
Definitions
- Account – An account accessible to the individual who signed up to the services.
- Booking Fee: The one-off fee payable by you to register for and secure your place at an event, as displayed on the platform at the time of registration.
- Consequential loss – Includes any consequential loss, special or indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise. However, your obligation to pay us any amounts for access to or use of the services will not constitute “consequential loss”.
- Event – An organised social dining event facilitated by us at a selected restaurant, as listed on the Platform from time to time.
- Liability – Any expense, cost, liability, loss, damage, claim, notice, entitlement, investigation, demand, proceeding or judgement (whether under statute, contract, equity, tort (including negligence), indemnity or otherwise), howsoever arising, whether direct or indirect and/or whether present, unascertained, future or contingent and whether involving a third party or us or you or otherwise.
- Personal Information – Any information or opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a tangible form or not.
- Platform – The online platform operated by us through which you may register your interest in events, complete your profile and receive event confirmations.
- Services: The services we provide to you, as detailed at the beginning of these Terms.
- Your Data – The information, photographs and registration details you provide to us when using the Services, including any Personal Information.
